These terms are an agreement between you and ConsentForms.com ("ConsentForms", "we", "us") and apply when you create an account or use our service. If you use ConsentForms for a business, you agree on behalf of that business. If you don't agree, please don't use the service.
1. Your account
- You must be at least 18 and give accurate information when you sign up.
- Keep your password and sign-in codes safe. You're responsible for activity in your account.
- You can invite team members. You're responsible for what they do in your workspaces and for removing access when they leave.
2. Plans and billing
- Some plans are free; paid plans are billed in advance, monthly or yearly, through Stripe.
- Paid plans renew automatically until you cancel. You can cancel any time from Billing, and the plan stays active until the end of the period you've paid for.
- Except where the law requires otherwise, payments aren't refundable for partial periods.
- Plans have limits, such as forms, monthly submissions and Jarvis AI forms. We may change prices or limits with at least 30 days' notice before your next renewal.
- If a payment fails, we may limit or suspend paid features until it's resolved.
3. Your forms and content
- You own the forms you create and the submissions you collect. You give us permission to store, process and display that content only as needed to run the service for you.
- You're responsible for your forms. That includes the wording of any consent, waiver, release or agreement, and making sure your forms and how you use them meet the laws that apply to you, including privacy, health-information, consumer-protection and e-signature laws.
- You must have a lawful basis to collect what your forms ask for, tell signers how you'll use it, and get a parent or guardian's consent where required.
- Templates are provided as general starting points and may not suit your situation.
4. Jarvis and AI-generated content
Jarvis uses artificial intelligence to draft forms from your descriptions, documents and links. AI output can be incomplete or wrong. Always review a form Jarvis builds before you publish it. Only give Jarvis content you have the right to use. Nothing ConsentForms or Jarvis produces is legal advice; for important forms, have a lawyer review your final wording.
5. Electronic signatures and records
ConsentForms records signatures with an audit trail, including the time, IP address, browser details and a fingerprint of the submitted content. Whether an e-signature is valid or enforceable for your purpose depends on the law and your use case, and you're responsible for deciding whether e-signatures are appropriate.
6. Payments on your forms
If you connect your own Stripe or Square account, payments go directly to that account under your agreement with that processor. You're responsible for those payments, including refunds, disputes and taxes. ConsentForms isn't a party to those transactions.
7. Acceptable use
You agree not to use ConsentForms to:
- Break the law or collect information without the permission the law requires.
- Phish, impersonate others, or collect passwords or full payment card numbers in form fields.
- Send spam or harass anyone.
- Upload malware, or try to break, overload, probe or get around the security or limits of the service.
- Infringe anyone's intellectual property or privacy.
- Resell the service or copy it to build a competing product.
We may remove content or suspend accounts that break these rules.
8. Privacy
Our Privacy policy explains how we handle information. For submissions you collect, we process signers' information on your behalf and according to your instructions.
9. Availability and changes
We work to keep ConsentForms running and secure, but we don't promise it will always be available or error-free. We may change, add or remove features. Keep your own copies of important records using the export tools.
10. Ending your account
You can stop using ConsentForms and close your account at any time. We may suspend or close accounts that break these terms, don't pay, or put the service or others at risk; where reasonable, we'll give notice first and a chance to export your data.
11. Disclaimers
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent the law allows, ConsentForms won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or $100.
13. Indemnity
You agree to defend and hold ConsentForms harmless from claims arising from your forms, your submissions, your use of the service, or your breach of these terms.
14. Governing law
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Arizona, and you and we consent to their jurisdiction.
15. Changes to these terms
We may update these terms. If changes are significant, we'll notify customers by email or in the app before they take effect. Continuing to use the service after that means you accept the updated terms.
